Stuart is an associate in the Planning and Environment team and has a wide range of experience in dealing with all aspects of Town and Country Planning law.

Stuart advises developers, national house builders, county and district councils, statutory undertakers, housing associations, landowners and lenders on a variety of matters including Section 106 Agreements, permitted development rights and prior approval applications, highway and drainage agreements, certificates of lawfulness, planning applications, objections, planning appeals, community infrastructure levy (CIL) and enforcement matters.

Stuart joined Clarke Willmott in 2022 with over ten years of experience in working in the legal industry.

Stuart can confidently guide clients through the complex process of preparing and negotiating Section 106 Agreements and Section 38 and 278 Agreements. Further, Stuart is able to provide clear advice in relation to permitted development rights and prior approval procedure and the submission of applications relating to certificates of lawfulness for both existing and proposed development.

  • Acting for several large county councils and district councils in relation to a high volume of Section 106 Agreements, Section 38 and 278 highway agreements and drainage agreements for a wide variety of developments and schemes across the South West.
  • Acting for several large London Borough Council in connection with the issue of enforcement proceedings.
  • Acting for a wide variety of national and local developers in relation to Section 106 Agreements, deeds of variation, highway agreements, drainage agreements, CIL advice, general planning advice, certificates of lawful use, APC Notices/ Bonds, vehicle crossover applications, s.50 licences and grant funding advice.
  • Acting for private clients in relation to strategic planning advice, planning applications, objections, certificates of lawfulness, appeals against enforcement action, and all other areas of planning, highways and public rights of way.
