The Ministry of Justice has announced increases to a number of County Court fees, expected to take effect from 13 July 2026, subject to parliamentary approval.
Given the imminent implementation date, care should be taken to ensure these increases are factored into financial planning and budgeting for the current year.
For social landlords, the following increases are worth noting:
- The issue fee for possession claims will increase from £404 to £415.
- The issue fee for injunction applications will increase from £377 to £387.
- The fee for issuing a warrant will increase from £148 to £152.
- Applications on notice will increase from £313 to £321.
- Without notice or consent, applications will increase from £123 to £126.
- The fee for appellant’s/respondent’s notice will increase from £171 to £175.

In light of these changes, social landlords should factor the revised fee levels into litigation budgets. When sending matters for issue, we recommend using broad wording such as “please deduct the appropriate court fee applicable at the date of issue” rather than specifying a fixed fee, to reduce the risk of applications being returned unissued if fees change.
