Serious injury FAQs

Will it cost me anything to make my claim?

There are various funding options available to help you bring an injury compensation claim. If you do not have existing legal expenses insurance or any other pre-existing funding, then we can discuss acting for you under a “no win no fee” or Conditional Fee Agreement (CFA), where your solicitor recovers your legal fees from the Defendant if your claim is successful.

When can I make a serious injury claim?

The sooner you make a serious injury claim, the better. Broadly speaking, under English law you have three years from the date of your injury to bring Court proceedings against the Defendant (a child can proceed any time up to their 21st birthday). The three-year limit may not apply if you suffered a serious brain or head injury (or have an existing condition) that left you lacking mental capacity.

It’s in your interest to instruct us as your solicitor as soon as you can, so we have enough time to thoroughly investigate your claim before initiating court proceedings.

If you delay instructing a solicitor, evidence could be lost, memories may fade and witnesses may become untraceable, which may make it more difficult to prove your claim.

If your injury occurred outside of England and Wales or if a defective product is involved, different time constraints may apply.

How long will my serious injury claim take?

How long your compensation claim could take will depend on many factors such as the type of injury you’ve sustained, the length of your recovery, the stance of the Defendant’s insurers, the timetable imposed by the Court and whether you are suffering financial problems.

Your solicitor will give you a better idea of the likely timescale once they have investigated your claim. If necessary, they can seek to obtain interim payments to cover your immediate financial losses and ongoing expenses.

Settling your claim before the long-term outcome of your injuries is known carries a risk because the full value of your compensation isn’t yet known. However, if you’d prefer us to settle your claim at an earlier stage, we will try to do so.
