Following Bill Bullivant’s recent lawbite on the impact of the proposed new public contracts regulations on social housing providers the Public Contracts Regulations 2015 (SI 2015/102) were finally published on 5 February 2015.
These Regulations formally replace the Public Contracts Regulations 2006 and implement Directive 2014/24 on public procurement. They also implement certain measures aimed at ensuring that small businesses have better access to public sector contracts.
The Regulations come into force on 26 February 2015 but will not apply to any contract award procedure commenced before 26 February 2015.
They are published as part of an overall drive to engaging with the market pre-procurement and ensuring better contract management. The Crown Commercial Service sees the publication of the new rules as enabling the public sector to drive value more effectively.
Social housing providers are already embracing the drive for value and this is supported by the Homes and Communities Agency’s announcement this week that, overall, registered providers have shown improved performance in meeting value for money standards.
