We were engaged to advise a leading retailer in relation to the conduct of two senior employees who had operated their own business and, as a result, obtained a significant secret profit.
Two senior employees of this leading high street retailer who were responsible for maintenance and facilities management set up their own business to supply such services to their employer. This business was unknown to the employer client. Over a number of years these individuals therefore put maintenance and facilities management work to their own business and, as a result, obtained a benefit in the sum of many millions of pounds.
We advised the organisation on the strategy and implementation on what was a complicated disciplinary process. As part of the process, the clients needed to be in a position to recover as much of the secret profit as possible. We therefore advised and supported them throughout a lengthy disciplinary process that ultimately resulted in the termination and recovery of significant sums of money.
