In the spotlight: Amy Peacey

In the Spring edition of our Social Housing Newsletter, our spotlight lands on Amy Peacey.

Name: Amy Peacey
Job title: Partner
Area of expertise: Commercial Law
Has worked at Clarke Willmott for: Five years

What kind of things can you help clients with?

I specialise in advising clients on all commercial contract matters. This includes drafting and reviewing commercial contracts and terms and conditions for all aspects of business. I regularly advise clients in the social housing on the risks associated with contracts with third parties and provide advice on how those risks can be minimised. I also assist registered providers with their standard contracts for the procurement of goods and/or services from their suppliers. These contracts can relate to anything from the supply of a widget to the installation of a new I.T system. In addition, I advise on data protection matters and how to ensure compliance with legislation when collecting, transferring, or processing data.

What do you enjoy most about your role?

I enjoy working with clients to protect their assets and resolve any issues that they have; making what may seem like complex legal issues easy to understand. I like to increase the awareness and understanding of potential legal issues with my clients so they can put in place mechanism to protect their businesses. I advise clients of all sizes, from family run businesses to large well-known organisations across a wide range of sectors. This means my role is very varied and I enjoy the new challenges and opportunities this brings.

What challenges have you faced recently?

The last 12 months have been challenging for both individuals and businesses. The last year has been full of uncertainty for a number of businesses due to the United Kingdom withdrawing from Europe and the various rules and regulations which have been implemented as a result of Covid-19. For example, not only have businesses been required to update their polices for the transfer of Personal Data between EU countries as required following Brexit but some business who haven’t had to worry about the collection and processing of personal data have had to implement procedures to meet Government requirements to support the NHS Test and Trace. There have been a number of changes for businesses this year and it has been challenging to advise clients that they need to make further changes, some with additional expenses, when for some businesses the future outlook is uncertain.

What is your top tip for clients at the moment?

Don’t just sign a contract, make sure you read it and take advice on the provisions and associated risks. What may seem like harmless clauses, may open you up to problems in the long run if the contract doesn’t contain the necessary protection measures.
