funding a claimFree interview If you are unhappy about the treatment you have received it is important to be aware of all your options before deciding what to do. There are a number of ways of funding a claim which you should consider and may not be aware of. Further, you may wish to receive provisional advice setting out how we can help and what is likely to be entailed. The important thing is to be clear before you start on what is involved and be fully informed. Public Funding The Legal Services Commission (LSC) allows specialist firms such as ours to obtain funding on behalf of people who have clinical negligence claims. They will grant funding if the claim has:
We can advise you or you can visit the LSC website on www.legalservices.gov.uk/calculator/index.htm to see if you qualify for legal representation. “No win No fee” (Conditional Fee Agreements) We are happy to see if you can bring your claim on a "no win no fee" basis. These are called Conditional Fee Agreements (CFA). In America if you win, your lawyer is allowed to take part of your damages. In England and Wales, a success fee is paid by the Defendant. Legal Expense Insurance Many people have Legal Expense Insurance (LEI) which is part of their household insurance. You may not be aware that you do. Often the policy will help you bring a claim assisting you with the expenses of paying for a solicitor. We would recommend that you check your household policy and we can advise if a clinical negligence claim is covered. It is often under the Legal Expenses heading on the schedule or in the accompanying booklet. We can help you see if you do have cover and then assist you fill out the forms. Trade Unions Members If you are a member of a Trade Union you may be able to receive help from the Union. We are happy to contact them on your behalf to see if they are prepared to help. Private Funding If no alternative means of funding is available, you may wish to fund a claim privately.
