how we helped our clientsHere are some case studies that illustrate the best examples of what we have achieved for our clients: Bringing a site into the 21st Century We are acting for a major developer in their high profile development of the old mail marketing site at Bedminster into a mixed use site together with high quality flats in the main building which has a running track on the roof top. We have been involved from inception and have given procurement advice on what is a complicated development. We have therefore dealt with all the building contracts, professional appointments, collateral warranties, bonds and guarantees. Development of a new wind farm We recently acted for a major procurer of wind farms in the development of their first wind farm in Scotland. This involved drafting and negotiating bespoke contracts for both the balance of plant contractor and the wind turbine contractor together with all ancillary documents. It also involved obtaining fund approval from multiple funders to all documents. Design advice case We recently acted for a major contractor who had been badly advised by their consultant in the design of a lock gate. We were successful in an adjudication (which took only 28 days) and were awarded over £300,000. The engineer refused to pay and we enforced through the courts in a month, eventually receiving payment in full plus interest. Design and workmanship case We acted for a housebuilder against a sub-contractor on a technically complex claim including the design and workmanship of a roofing package. We recovered over £200,000 in a negotiated settlement. Urban regeneration case Clarke Willmott were appointed to the SWRDA legal panel in autumn 2006. As a consequence of this appointment we have been instructed to act in a complex multi-million pound urban regeneration project in Somerset involving contaminated land, listed buildings and grant funding issues. Extensive office development project We acted for this major local developer in respect of all construction documentation arising out of a very significant office development in central Bristol. The complex funding arrangements in this case meant there were considerable negotiations necessary between the parties to reach an agreement. Industrial site - soil stabalisation case We acted for this substantial plc on a half million pound claim in respect of soil stabilisation works at an industrial site. This was a multi-party action involving claims under the main contract and in respect of a collateral warranty. Multi-million pound retail sector dispute We advised a major supermarket chain on a complex multi-million pound dispute involving over 7000 separate items with a contractor leading to two adjudications, a mediation and litigation (including a successful Court of Appeal hearing). Developing a local school The Clarke Willmott construction team were appointed to act for this district council in the development of a new science block at a local school. Working in conjunction with Currie and Brown, the employers agent and QS, Clarke Willmott will both advise upon procurement strategy and also draft all contracts, appointments and warranties for the work. The new science block will cost in the region of £4 million and work will start in July 2007. Advising a housing and development group We advised and represented this major international housing and development group on all disputes and claims by contractors, sub-contractors and others in the South West and South Wales. In general; matters are settled by negotiation but we also represent this client in proceedings as and when required. |
