Recent cases include:

  • advising on public liability claims regarding labeling in the 1960s
  • successfully resolving claim for secondary exposure from the 1950s
  • successfully recovering contributions for damages and costs from insurers following a review of  the company history
  • defending claim for contribution arising out of largest damages claim for an asbestos related condition
  • acting in arbitration dispute between insurers regarding individual contributions.

Employer’s Liability

Recent cases include:

  • successfully resisting a slip and trip claim following the retrieval of CCTV and its enhancement;
  • advising insurers on the legal test for a patient for a claim previously settled on terms and successfully defending significant claim to appeal;
  • advising insurers for occupiers and successfully defending claim on appeal with all liability assigned to employer;
  • reinvestigating public liability claim following alleged injury from falling flower pot and establishing no injury caused with claim discontinued.

Self Insureds

We have assisted a company to set up a captive and to handle all EL claims made with proactive health and safety advice on reducing the likelihood of claims. Over the period of our involvement we have seen a reduction in the number of claims made and the value of claims paid.

We have been instructed by a major plc to handle all its claims in England and Wales.
