Recent Cases

The team's recent highlights include;

  • The national media focussed on the fact that our Equitable Life Trapped Annuitants case involved only 400 litigants out of 56,000 policyholders. These individuals were prepared to proceed under Conditional Fee Agreements with limited insurance cover, whereas the main group of policyholders were left not having taken any action. We pride ourselves as having been at the forefront of litigation funding issues such as this being prepared to back our professional judgment on the prospects of success of claims.
  • Acting for the respondent in Sims -v- Hawkins in the Court of Appeal, one of the lead cases on costs.
  • Acting for a local authority under the terms of an innovative form of Collective Conditional Fee Agreement drafted by ourselves which provided maximum protection for the local authority on the issue of costs. The validity of the new agreement was challenged by the losing Defendant but was upheld at first instance. The Law Society intervened in the action to support the agreement and the Court of Appeal has now confirmed that this form of funding is appropriate. The case of Gloucestershire County Council -v- Evans is one of the foremost cases on the development of litigation costs, especially for public bodies.
